These Terms of Use (these “Terms” or these “Terms of Use”) constitute a legally binding agreement made between you (“you”) and Utopia Med Tech Pvt. Ltd., (Diagnostics at Doorstep, "DaD" , “we”, “us”, or “our”), concerning your access to and use of the https://www.dadlabs.com website as well as any other media form, media channel, DaD website, software, or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”). You agree that by accessing the Site or creating an account on the Site, you (i) represent that you are eighteen (16) years of age or older and have the capacity to read and understand these Terms, (ii) represent and warrant that you have read and understood these Terms and our Privacy Policy and (iii) agree to be bound by all of these Terms. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF USE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

 

1.  Account Creation

To access certain features and services on the DaD website and App, users are required to create an account. During the registration process, users must provide accurate and complete information, including but not limited to:

• Age
• Name
• Date of Birth
• Gender
• Phone Number
• Email Address
• Residential Address

Users are solely responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account.

 

2. Services and Terms of Use
   1. Sample Collection and Report Generation

DaD provides sample collection services for diagnostic tests. Users can schedule sample collections based on the booking date and available time slots. DaD reserves the right to modify or cancel sample collection appointments due to unforeseen circumstances, such as ongoing pandemic restrictions, political issues, weather conditions, or other factors beyond DaD's control. Users will be promptly informed of any changes or cancellations via messages or emails. Users are responsible for regularly checking their messages and emails for updates.

 

2.  Report Generation

DaD aims to generate test reports within 24-48 hours from the time the sample is sent to the laboratory for examination. However, some tests may require longer processing times, and users will be informed about such cases during sample booking or collection. Users acknowledge that there may be delays in receiving test results, and they agree to bear any such delays.

 

3. Offers and Coupon Codes

DaD may offer promotional offers and coupon codes for its services. The following terms and conditions apply to these offers and coupon codes:

1. Validity: Offers and coupon codes are valid for a limited period as specified in the promotion. Users must avail of the offer or apply the coupon code within the specified validity period.
2. Redemption: Offers and coupon codes can be redeemed only once per user unless otherwise specified. Multiple offers or coupon codes cannot be combined unless explicitly stated.
3. Eligibility: Offers and coupon codes may have specific eligibility criteria, such as minimum order value, specific tests, or targeted users. Users must fulfill the specified criteria to be eligible for the offer or coupon code.
4. Non-Transferable: Offers and coupon codes are non-transferable and cannot be exchanged for cash or any other form of value. They can only be used for availing discounts or benefits as mentioned in the offer or coupon code.
5. Exclusions: Offers and coupon codes may not be applicable to certain tests, services, or locations. Such exclusions will be clearly mentioned in the offer or coupon code details.
6. Modification or Cancellation: DaD reserves the right to modify, extend, or cancel any offer or coupon code at any time without prior notice. In case of cancellation, no compensation or alternative offer will be provided.
7. Abuse of Offers: Any misuse, abuse, or fraudulent use of offers or coupon codes may result in the cancellation of the order or termination of the user's account. DaD's decision regarding such matters will be final.

 

4. App Wallet Money Policy:

The wallet money earned by users through the referral program can only be used to purchase tests within the DaD - Diagnostic At Doorstep (DaD) app. Users cannot withdraw the wallet money as cash or transfer it to any external accounts. The wallet money can be utilised solely for test bookings and related services offered by DaD.

By participating in the referral program and earning wallet money, users acknowledge and agree that the funds in their wallet can only be used within the DaD app. The specific terms and conditions related to wallet money utilisation, including any limitations or fees, will be clearly specified within the app.

Users are responsible for managing and utilising their wallet funds within the app. DaD reserves the right to modify the wallet money policy and its terms of use at any time. Any changes will be communicated to users through app notifications or other means.

5.  Modification of Terms

DaD reserves the right to modify or amend these Terms and Conditions at any time without prior notice. Any changes will be effective immediately upon posting on the DaD website or App. Users are encouraged to review these terms periodically to stay informed of any updates.

 

6. Termination

DaD reserves the right to terminate or suspend any user's account or access to the website or App at its sole discretion, without prior notice or liability, for any reason, including but not limited to a breach of this Agreement.

 

7.  Intellectual Property

The DaD website, App, and all its content, including but not limited to text, graphics, logos, images, and software, are the intellectual property of DaD and are protected by applicable copyright, trademark, and other intellectual property laws. Users may not reproduce, distribute, modify, transmit, or use any content from the DaD website or App without prior written permission from DaD.

 

8. Limitation of Liability

DaD and its affiliates, directors, officers, employees, agents, and partners shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use of the DaD website or App, including but not limited to the loss of data, revenue, or profits.

 

9.  Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of [Jurisdiction]. Any legal actions or proceedings arising out of or relating to this Agreement shall be brought exclusively in the courts of [Jurisdiction].

 

10.  Severability

This Agreement constitutes the entire agreement between the user and DaD concerning the use of the DaD website and App and supersedes all prior or contemporaneous agreements, communications, and understandings, whether oral or written.
